PURPOSE This Intellectual Property Policy establishes the intellectual property framework for the Unified AI Incident Framework (UAIF), a specification published by ODA3 Pvt Ltd trading as ODA3 Institute. It is the master IP governance document. All other UAIF IP instruments (CLA, Commercial Licence, Data Contribution Agreement, Trademark Policy, Certification Charter) are subordinate to and consistent with this Policy. In case of conflict, this Policy prevails.

1. Scope and Application

This Policy applies to: (a) the UAIF specification and all its versions; (b) the UAIF reference implementation code; (c) the UAIF Conformance Test Suite; (d) UAIF Sector Calibration Packages; (e) all contributions to the above by third parties; (f) the UAIF brand, trademarks, and certification marks; and (g) any algorithms, methodologies, or data assets developed under the UAIF programme.

This Policy does not apply to third-party implementations of UAIF that do not incorporate ODA3-owned intellectual property, or to works that reference UAIF without reproducing its content. The governing public licence for the UAIF specification and all GAISSF Ecosystem components is the GAISSF Ecosystem Licence (GEL v1.0), published by ODA3 Institute at https://docs.oda3.org/gel. All other IP instruments referenced in this Policy operate within and are subordinate to GEL v1.0.

2.1 ODA3 Ownership

ODA3 Pvt Ltd (trading as ODA3 Institute) is the sole copyright owner of the UAIF specification, reference implementation, Conformance Test Suite, and Sector Calibration Packages. Copyright in all versions of these works is reserved by ODA3 Pvt Ltd, © 2026 ODA3 Pvt Ltd. All rights reserved except as expressly licensed below. In all market-facing and research communications, ODA3 Pvt Ltd operates as “ODA3 Institute” per the GEL v1.0 Preliminary Clause.

2.2 Contributed Content

Third-party contributors to the UAIF specification retain copyright in their individual contributions. By signing the UAIF Contributor Licence Agreement (CLA — Supporting Document UAIF-CLA-002), contributors grant ODA3 Institute (ODA3 Pvt Ltd) a perpetual, irrevocable, worldwide, royalty-free licence to reproduce, modify, publish, and distribute their contributions, including in commercial products, under the GAISSF Ecosystem Licence (GEL v1.0) and proprietary commercial licences, as specified in UAIF-CLA-002. This grant is made pursuant to GEL v1.0 Section 8 and is necessary for ODA3 Institute to publish a unified specification under a single consistent licence. The CLA rights granted to ODA3 Institute survive any termination of the contributor’s own GEL v1.0 licence rights (GEL §8.1).

2.3 Attribution Requirements

REQUIRED ATTRIBUTION Any party reproducing, adapting, or implementing this specification MUST include the following attribution: "GAISSF Ecosystem © ODA3 Institute, GEL v1.0 | https://docs.oda3.org/uaif" — consistent with GEL v1.0 Section 6. Short-form attribution (space-constrained contexts): "GAISSF Ecosystem © ODA3 Institute, GEL v1.0".

3.1 Why GEL v1.0 (GAISSF Ecosystem Licence)

The UAIF specification is published under the GAISSF Ecosystem Licence (GEL v1.0), a source-available, non-commercial-by-default licence developed and maintained by ODA3 Institute. GEL v1.0 grants worldwide non-commercial use with attribution while reserving all commercial, certification, and audit rights exclusively to ODA3 Institute. This model: (a) enables broad non-commercial adoption for governance, research, and evaluation without restriction; (b) preserves ODA3 Institute’s ability to sustain the specification through commercial licensing of Sector Calibration Packages and certification services; (c) ensures integrity of conformance and certification through exclusive ODA3 Institute authority under GEL §10.5. 4. Patent Policy

4.1 Patent Non-Assertion Covenant

ODA3 Pvt Ltd irrevocably commits that it will not assert any patent claims it owns or controls against any party for the purpose of implementing the UAIF specification in conformance with its published terms. This covenant:

Applies to all UAIF MAJOR version 1 specifications and all MINOR and PATCH updates within that MAJOR version

Applies worldwide, to all parties, without restriction by jurisdiction or entity type

Does not apply to implementations that are not conformant with the published specification

Does not apply to use of ODA3 patents outside the scope of UAIF implementation

Does not extend to third-party patents; ODA3 makes no representation about third-party patent freedom

This covenant is a public, irrevocable commitment. Extension to future MAJOR versions will be evaluated at ODA3's discretion with 90 days' written notice. Any narrowing of this covenant requires a minimum 180-day notice period published at https://docs.oda3.org/uaif and https://docs.oda3.org/gel.

4.2 Defensive Publication Policy

ODA3 Institute commits to placing novel algorithms developed for UAIF into the public prior art record via defensive publication rather than patent prosecution. This policy is part of ODA3 Institute’s IP framework under the GAISSF Ecosystem Licence (GEL v1.0). See Supporting Document UAIF-DPR-007 and UAIF Technical Specification Section 13.3. This policy applies to algorithms integral to UAIF’s core functionality, including severity scoring, deduplication, and context modifier logic. Submissions are made to IP.com or an equivalent recognised defensive publication database using the template in UAIF-DPR-007, and published at https://docs.oda3.org/uaif/defensive-publications. Defensive publication prevents any party — including ODA3 Institute — from obtaining patents that could block conformant UAIF implementations. Notice of any narrowing of the patent non-assertion covenant must be published at https://docs.oda3.org/uaif and https://docs.oda3.org/gel with a minimum 180-day notice period.

5. Trademark Policy

The following marks are trademarks or service marks of ODA3 Pvt Ltd (registration applications noted): 'UAIF' / 'Unified AI Incident Framework' (application 7770038); 'GAISSF' (application 7770036); 'AI-IRF' / 'AI Incident Response Framework' (application 7770037); 'ODA3' / 'ODA3 Institute' (application 7767483); 'UAIF-Compatible'; 'UAIF Certified'. Full trademark provisions are governed by GEL v1.0 Section 9. In case of conflict, GEL v1.0 Section 9 prevails. Summary (full rules: UAIF-TM-005):

7. Data Governance

Organisations contributing calibration data to the UAIF benchmarking pool are subject to Supporting Document UAIF-DCA-004. Key principles:

Contributed data must be genuinely anonymised to GDPR Article 4(1) standard before submission — pseudonymised data is not acceptable

ODA3 may use contributed data in commercial products including Sector Calibration Packages

Contributors retain withdrawal rights per UAIF-DCA-004 Section 8

Aggregated and derived datasets may be retained by ODA3 Institute indefinitely, even after individual withdrawal, because aggregated data cannot be attributed to individual contributors. Use of contributed data as training data, fine-tuning data, or prompt corpus for commercial AI or machine learning models requires a separate written licence from ODA3 Institute, consistent with GEL v1.0 Section 3.6

8. Enforcement

ODA3 Institute (ODA3 Pvt Ltd) reserves all rights to enforce its intellectual property under applicable law, including the Copyright Act 1957 (India), the Trade Marks Act 1999 (India), the Patents Act 1970 (India), and applicable international treaties including the Berne Convention, TRIPS, and the Paris Convention. Licence termination for breach of the GAISSF Ecosystem Licence (GEL v1.0) is governed by GEL v1.0 Section 7, including the 30-day cure period for non-material breaches (GEL §7.3) and the 15-day first-instance commercial breach exception (GEL §7.4). ODA3 Institute will pursue enforcement action against: passing off non-conformant implementations as UAIF-certified or UAIF-compatible; use of UAIF marks without authorisation; distribution of Sector Calibration Packages without a valid Commercial Licence Agreement; and misrepresentation of the source, authorship, or endorsement of UAIF-derived works.

9. Policy Amendments

This Policy may be amended by ODA3 Institute with 90 days’ written notice published at https://docs.oda3.org/uaif and https://docs.oda3.org/gel, with simultaneous notice to CONTACT_AT_ODA3_DOT_ORG subscribers. Amendments do not apply retroactively to licences already granted. Any amendment that narrows the patent non-assertion covenant requires a minimum 180-day notice period published at the same locations.

10. Governing Law

This Policy is governed by the laws of India, without regard to conflict-of-law principles. Any dispute shall first be subject to 30 days’ good-faith negotiation following written notice. If unresolved, disputes shall be referred to binding arbitration under the Indian Arbitration and Conciliation Act, 1996, as amended, administered by the Delhi International Arbitration Centre (DIAC) under the DIAC Rules in force at commencement. Seat and venue: Delhi, New Delhi, India. Language: English. Consistent with GEL v1.0 Section 14. Either party may seek interim injunctive relief from any court of competent jurisdiction without waiving the right to arbitration. Nothing in this Policy limits or waives statutory rights that cannot be contracted away under applicable law, including fair use, quotation rights for criticism or commentary, and academic citation rights, consistent with GEL v1.0 Section 11. If any provision of this Policy is held invalid or unenforceable by a court or arbitral tribunal, that provision shall be modified to the minimum extent necessary to make it valid; the remaining provisions continue in full force, consistent with GEL v1.0 Section 19.
